COPPERHILL LIMITED WARRANTY 1. Limited Warranty In conjunction with its authorized installation dealers and the manufacturers referenced herein and subject to the terms and conditions hereof, Copperhill Alternative Energy Inc. (hereinafter "Copperhill") agrees to co-ordinate a limited warrantee on its solar products (“product” or “products”), systems (“system” or “systems”) and/or components (“component” or “components”) as outlined below to provide a limited twenty year parts and labour warrantee (the “Warranty”) on such products, systems and components (collectively, the “Systems”). Other than as expressly set out herein, the Warranty shall not apply to products, services or components purchased by Copperhill from other manufacturers including without limitation any solar panels, inverters, tracking control systems and Atrax structures which comprise part of a System. In lieu of providing a warranty on such products, systems or components, Copperhill will make available to the customer any warranties received by it from such manufacturers. The express exceptions to this rule are as follows: (a) In the event the manufacturer’s warranty covers the replacement of solar panels which are part of a System, Copperhill shall provide and install such replacement solar panels for the duration of the Warranty, provided the claim otherwise meets the terms and conditions of this Warranty. (b) In the event the manufacturer’s warranty covers the replacement of inverters which are part of a System in the initial ten years of the Warranty or the manufacturer’s extended liability warranty would have covered the replacement of inverters which are part of a System in the last ten years of the Warranty, Copperhill shall provide and install such replacement invertors for the duration of the Warranty, provided the claim otherwise meets the terms and conditions of this Warranty. (c) In the event the manufacturer’s warranty covers the replacement of Atrax frames which are part of a System, Copperhill shall provide and install such replacement Atrax frames for the duration of the Warranty, provided the claim otherwise meets the terms and conditions of this Warranty.
2. Installation by Dealer In order for the Warranty to apply, all installations of the System must be done by authorized Copperhill installation dealers (“Copperhill Installation Dealers”). Such Copperhill Installing Dealers are responsible for the installation of the System to the Copperhill standard and any installation defects are the sole responsibility of the Copperhill Installing Dealers for a period of one (1) year. In the event there are no installation defects during such time or they have been rectified by the applicable Copperhill Installing Dealers, Copperhill shall assume the responsibility for warranting the installation of the System to the Copperhill standard for the balance of the twenty years of the Warranty. 3. Commencement of Coverage and Timing The Warranty time is calculated starting at To start Warranty coverage, the customer must complete, or ensure that the Copperhill Installing Dealer completes, the warranty information page included with the installation instructions provided with the System. The warranty card must be received by Copperhill no later than thirty (30) days after the installation of the System or within (1) year of the manufacture date. It must be completed in full including serial numbers and have the required photographs attached. Photographs can be e-mailed. It is the responsibility of the customer to ensure that Copperhill head office has received such information on time.
No deductible fees shall apply for the first two years of the Warranty. In the event a customer wishes to apply the Warranty in years three to five, it shall first be bound to pay a deductible fee in the amount of $50.00, plus applicable taxes, and in the event a customer wishes to apply the Warranty in years six to twenty, it shall first be bound to pay a deductible fee in the amount of $250.00, plus applicable taxes. 5. Warranty Preconditions 5.1 The Warranty shall not apply unless the following pre-conditions have been fulfilled: (a) The customer invoking the Warrantee purchased the System through an authorized Copperhill sales channel and did not obtain the System through resale; (b) The System was installed by an Copperhill Installation Dealer; and (c) The information set out in Section 3 above was delivered to Copperhill’s head office within the time limits set out therein. 6. Exclusions Warranty coverage excludes any product, system or component that: (a) was not installed by a Copperhill Installation Dealer; (b) has been subject to accident, alteration, abuse, misuse, tampering, negligence, damage by flood, fire or act of God; (c) contains non-authentic Copperhill accessories or replacement parts; (d) was repaired, serviced, altered or modified by someone other than a Copperhill authorized dealer; or (e) has been damaged by excessive force, installation by customer, alterations by unauthorized personnel and/or use in a corrosive environment. 7. Limitation of Liability 7.1 This Warranty is the sole warranty offered by Copperhill to you. Copperhill disclaims any and all other warranties to the fullest extent permitted by law, whether express or implied, including any warranty of merchantability or fitness for a particular purpose except as provided herein. 7.2 Your sole remedies under this Warranty are those described herein. Unless otherwise stated, Copperhill’s liability for actual damage from any cause whatsoever is limited to the amount paid by you for the System. Copperhill disclaims any and all liability and consequential or other damage whether based on breach of contract, tort (including negligence), product liability or any other legal theory. In no event will either party be responsible for any lost profits or savings, incidental damage or other economic damages. 7.3 Copperhill shall not be liable for service, labour or transportation charges or for damages for delay caused by defective material or workmanship or for personal injuries or damage to property caused directly or indirectly by any product, system or component or by its use or operation experienced by the customer or any other person whatsoever. 7.4 Any provision of this Warranty found invalid or unenforceable under applicable law, shall to that extent be deemed omitted, and the rest of this Warranty shall be in full force and effect. 8. Customer Care 8.1 For service under this Warranty or for further information please contact Copperhill’s customer service department. Warranted parts must be kept available for inspection for a minimum of sixty (60) days. Replacement parts will be shipped and installed provided the claim qualifies under the terms of the Warranty. Notwithstanding anything to the contrary contained herein, Copperhill’s obligation to replace and /or repair products, systems or components under this Warranty shall only apply in the event a particular claim complies with the terms of this Warranty as judged by Copperhill’s customer service department in its sole discretion.
